Random Breath Testing 2 : Capacity for police to randomly pull drivers over without the need to give a reason and perform a breath test to determine whether the driver has a blood alcohol content (BAC) higher than the accepted legal limit for their licence category. Persons who blow a high BAC are required to submit a blood sample for confirmation of their BAC as this is legally required for prosecution. However, a person who refuses to submit to a blood test after being found to have a high BAC may still be charged with refusing to submit to a blood test. Penalties differ between jurisdictions
