Solid Waste 1 : (1) In general, solid wastes are non-liquid, non-soluble discarded materials ranging from municipal garbage to industrial wastes that contain complex and sometimes hazardous substances. Solid wastes include sewage sludge, agricultural refuse, demolition wastes, and mining residues. (2) For purposes of regulation under the Resource Conservation and Recovery Act, solid waste is any garbage; refuse; sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility; and other discarded material. Solid waste includes solid, liquid, semisolid, or contained gaseous material resulting from industrial, commercial, mining, and agricultural operations and from community activities. Solid waste does not include solid or dissolved material in domestic sewage or irrigation return flows or industrial discharges which are point sources subject to permits under Section 402 of the Clean Water Act. Finally, solid waste does not include source, special nuclear, or byproduct material as defined by the Atomic Energy Act.
