"The Homeland Security Act of 2002, Pub. L. No. 107-296, 116 Stat. 2135 (2002) (codified predominantly at 6 U.S.C. §§ 101-557), as amended with respect to the organization and mission of the Federal Emergency Management Agency in the Department of Homeland Security Appropriations Act of 2007, Pub. L. No. 109- 295, 120 Stat. 1355 (2006), established a Department of Homeland Security as an executive department of the United States. The Homeland Security Act consolidated component agencies into the Department. The Secretary of Homeland Security is the head of the Department and has direction, authority, and control over it. All functions of all officers, employees, and organizational units of the Department are vested in the Secretary". (DHS, National Response Framework List of Authorities and References.
