Discrimination 6 : The making of a distinction in favour of or against, a person based on the group, class, gender, ethnicity, sexual preferences, religion or category to which that person belongs rather than on individual performance or merit. Discriminating between employees on the grounds of merit is generally lawful and common in most democracies but discrimination on grounds such as skin colour, sexuality, ethnicity, language or religion is illegal in most countries
