CBRN Safety 110 : Chapter II - Domestic CBRN CM (6) Applicable Laws and Agreements in the Domestic Operational Environment: (A) Key Executive and Legislative Guidance: (3) The Robert T. Stafford Disaster Relief and Emergency Assistance Act: The Stafford Act is the primary legal authority for federal participation in domestic DR. When incidents of national significance that are declared disasters or emergencies by the President occur, federal support to states is delivered IAW relevant provisions of the Stafford Act. A governor may request the President to declare a major disaster or emergency if the governor finds that effective response to the incident is beyond the combined response capabilities of the state and affected local governments. Based on the findings of a joint federal-state-local preliminary damage assessment indicating the damages are of sufficient severity and magnitude to warrant assistance under the act, the President may issue a major disaster or emergency declaration. The President may unilaterally provide federal emergency assistance under the Stafford Act when the President determines that an emergency exists for which the primary responsibility for response rests with the USG. Based upon the overwhelming nature of a no-notice catastrophic CBRN incident, the approval process will be expedited through federal levels. Federal assistance takes many forms - including the direct provision of goods and services, financial assistance (through insurance, grants, loans, and direct payments), and technical assistance - and can come from various sources. Under the NRF construct, DOD is designated a supporting agency for all ESFs and a cooperating agency for a number of NRF support and incident annexes. DOD approved support under the Stafford Act is generally provided on a reimbursable basis. The ESF coordinators, located in the JFO, serve as the primary operational-level functional mechanisms to provide assistance to state, local, and tribal governments or to federal departments and agencies conducting missions of primary federal responsibility
