Chapter II - Domestic CBRN CM (6) Applicable Laws and Agreements in the Domestic Operational Environment: (B) Key DOD Guidance: (2) Special Considerations: (a) Intelligence Oversight Information Collection, Sharing and Handling: (1) In light of todays changing environment, commanders and their staffs should carefully consider the different rules when planning domestic operations. (2) The SJA role is especially important during domestic operations as the parameters under which DOD operates are different in the US than they are overseas. The military commanders need for information and intelligence within the homeland is on the rise - force protection information and counterintelligence integrated into domestic operations are expected due to a heightened awareness of potential terrorist threats. These needs and expectations pose unique issues in the information and intelligence gathering arena. DOD intelligence components are restricted by a set of rules referred to as intelligence oversight, governed and regulated by DODD 5240.01, DOD Intelligence Activities, and DOD 5240.1-R, Procedures Governing the Activities of DOD Intelligence Components that Affect United States Persons. Everyone else in DOD, is subject to a different set of rules governed by DODD 5200.27, Acquisition of Information Concerning Persons and Organizations not Affiliated with the Department of Defense. Therefore, the commander must direct his need for information or intelligence to the right component - the component with the capability and authority to achieve the commanders intent. Determining the nature of the data and the right unit to gather it are areas that often require SJA input
