Medical Examination 3 : Medical examinations are becoming increasingly popular in assessing prospective employees' abilities to perform the job that they have applied for. Employers must, however, have the prospective employee's consent to conduct such a medical examination. If no consent is given, the performance of such an examination could constitute assault (trespass to person). If the examination is consented to but performed by an unqualified person or the examination is totally unnecessary and unjustified, that examination could still constitute an assault. Examinations that examine irrelevant abilities or capabilities may prove to be discriminatory
