Appeals


Appeals : Nearly every decision in the life of a workers' compensation claim can be appealed. The process usually begins with a Request for Hearing filed by the worker or representative of the worker (usually an attorney) with the Workers' Compensation Board (WCB). (See: Workers' Compensation Board). The appeal is assigned to an administrative law judge who presides over a hearing. The administrative law judge's decision can be appealed to the WCB. Any action the WCB takes can be appealed to the state appellate court system. Appeals of medical or vocational issues are decided by the director of the Oregon Department of Consumer and Business Services
