"The National Emergencies Act of 1976, 50 U.S.C. 1601 et seq, establishes procedures for Presidential declaration and termination of national emergencies. The Act requires the President to identify the specific provision of law under which he will act in dealing with a declared national emergency and contains a sunset provision requiring the President to renew a declaration of national emergency to prevent its automatic expiration. The Presidential declaration of a national emergency under the Act is a prerequisite to exercising any special or extraordinary powers authorized by statute for use in the event of national emergency".
